Abstract

This paper focuses at studying the concepts of punishments in Islamic and Pakistani legal system. Contents analysis method was used to collect data. Study reveals that Punishment of imprisonment is accepted form of punishment in Islamic and Pakistani legal system. Islam considerers imprisonment as a discretionary punishment; judge has an option to exercise punishment of imprisonment against any person if he thinks that it will be better for the reformation of the offender and society. In Pakistani legal system, imprisonment is considered as a primary punishment; it is being exercised against all types of criminals whether it suits with their nature of crimes or not. In Pakistan, imprisonment can be simple or rigorous, in addition, it might be fixed term or life imprisonment. At present that there are 116 prisons in Pakistan, where more than eighty thousand prisoners have been detained, out of them fifty thousand prisoners are undertrial prisoners, while twenty-nine thousand are convicted prisoners.
